   JOINING THIS LAWSUIT

 

Any employee who worked for either Presidential Limousine; or CLS Nevada, LLC (CLS Transportation) as a limousine driver in Nevada, at any time since June 19, 2006, may join in this lawsuit by filling out the Consent To Join form. However, an employee is under no obligation to join this lawsuit, but an employee may choose to bring legal action on his/her own or simply decide to do nothing. However, if the Court or a jury rules in favor of the Plaintiffs in this case and finds that any alleged off-the-clock work performed by the employees is compensable overtime under FLSA, then only those employees who have joined in this lawsuit and who have submitted a Consent To Join will be eligible to share in any recovery of unpaid overtime which may be awarded by the Court in this case.

Act Promptly -- Delay Could Reduce Any Recovery

 

In an action or lawsuit under FLSA, a successful claimant or plaintiff may be able to recover alleged unpaid overtime compensation for a limited time period, called the "statute of limitations" period. This period is usually two years, but it can be increased to three years if a court finds that an employer "willfully" violated provisions of FLSA. The statute of limitations period under FLSA is triggered by the filing of a consent form with a court and provides remedies for the two or three preceding years.

 

If the Court or a jury determines that any off-the-clock work is compensable time under FLSA, as alleged by the Plaintiffs, and if the Court or a jury rules that the Plaintiffs were entitled to recovery of alleged unpaid overtime in this lawsuit, only employees who have joined this lawsuit by filing their consent to join will be eligible to share in recovery of any unpaid FLSA-mandated overtime wages as determined by the Court or a jury. However, as of this time, the Court has not made any determination of merits of Plaintiffs' allegations in this lawsuit, and the Court has not determined any liability on part of defendants.
